Abstract (EN)

The crime of blackmail is regulated in Article 107 of the Turkish Penal Code No. 5237, in the seventh part titled "Offences Against Liberty" of the second chapter titled "Offences Against the Person". Although the provision of the crime of blackmail seems quite understandable at first glance, it has been the subject of many debates in the doctrine. In the thesis, the crime of blackmail is examined in the light of the discussions in the doctrine and judicial decisions. In the first part of the thesis, the concept of freedom of will, which constitutes the legal subject of the crime, is discussed, and in the second part, the crime of blackmail is examined together with its elements. In the third and final part, the special forms of the crime, sanctions and prosecution are handled, and in the conclusion part, the conclusions reached in line with the discussions made are put forward.
