Trademark rights and crimes against trademark rights in Turkish law

ABSTRACT 6 Trademark offenses are regulated under Article 30 as 7 paragraph of the Industrial Property Law No 6769. With this regulation, it can be said that the criticisms in the previous legal regulations regarding brand crimes have been solved to a great extent. With the increase in the area covered by the brand, especially in the commercial life, the brand has to be subject to criminal regulations in order to protect the brand right holders, the consumers who use the brand and the trade market. Within this framework, the legislator has also regulated three types of trademark offenses and foresees separate penalties for these offenses. Again, the legislator stipulated that the investigation and prosecution could be carried out only if the trademark was registered and the complaint was found. In addition, security measures specific to legal entities and effective regret provisions can be applied to these crimes.
