Abstract (EN)

This study discusses the legal character of the institution of adequate pay compensation from the perspective of private law. The adequate pay compensation is a common dispute in the Turkish Legal System and it has been discussed from various aspects although it has not been resolved despite these lasting discussions. The study comprises of two chapters. The first chapter introduces the historical development of adequate pay compensation in the Turkish Legal System, examines its legal character and gives the crucial legal concepts regarding the compensation. The second chapter examines some special cases which are controversial with regard to the claiming of adequate pay compensation and whether it is claimable.
