Examination of the state of emergency regimes after 15th July coup attempt in Turkey (21 July 2016-19 January 2017)

Extraordinary management procedures or the state of emergency regimes are procedures in which the state appeals when it faces an extraordinary threat or danger which cannot be overcame by the ordinary rules of the law of the state. The state of emergency was declared on the 21st of July, following the coup attempt which organized on the 15th July 2016 by the Fethullah Terrorist Organization Parallel State Structure (FETO/ PSS). The state of emergency that continued for a total of 2 years (730 days) has ended after extension of 7 times on the 18th July 2018 In this thesis, the state of emergency applications, which were in force for 2 terms between the 21st July 2016 and the 19th January 2017 were addressed. This study is designed to investigate the July 15 Coup Attempt with a scientific point of view. The purpose was to shed light on the social, legal, political, economic, and cultural consequences of the event according to scientific data and as well as to reveal the individuals and institutions which were involved in the attempt. In addition, the current study examined the statutory decrees under the state of emergency between the 21st July 2016 and the 19th January 2017 and these were compared with the past state of emergencies in the history of Turkey, As a result of this study, it was shown that the state of emergency, which is a method of restricting fundamental rights and freedoms, was used effectively after the coup attempt on the 15th July 2016. The Coup Attempt resulted in deeper and more profound effect as it is distinct from past state of emergency applications in the aftermath since it is an event that Turkey has never been encountered before, which has unique qualities as a coup attempt.
