Abstract (EN)
This thesis examines whether the decisions rendered by the Human Rights and Equality Institution of Türkiye (TİHEK) and the Ombudsman Institution are effective and adequate in combating disability-based discrimination. The study first explores the definitions and categories of disability, including legal criteria for determining who qualifies as disabled. It then analyzes the concept and types of discrimination within the framework of both international and Turkish law. Subsequently, the decisions issued by TİHEK and the Ombudsman Institution concerning disability-related discrimination are assessed. Finally, the thesis evaluates whether these decisions provide sufficient and effective protection in addressing such discrimination.
