Abstract (EN)

Today's rapidly advancing artificial intelligence technologies utilize health data that is highly needed for diagnosis, treatment, patient management services, and medical research. However, the processing of such highly sensitive data by artificial intelligence poses significant risks to individuals' privacy and the protection of their personal data. Within the scope of this dissertation, the types of liability arising from the use of artificial intelligence systems in healthcare, the health data processed through these systems, and the consequences of failing to protect this data are examined. In this regard, the processing of personal data within the framework of Law No. 6698 on the Protection of Personal Data (KVKK) is explained in detail, data breaches occurring through artificial intelligence systems are supported with examples, and the types of liability that may be arise under Turkish law as a result of such breaches are discussed. As a result, solution proposals are developed to address the disadvantages caused by the use of artificial intelligence, taking into account the fundamental principles and current regulations.
