Abstract (EN)

The necessity for the judiciary to be independent and impartial from other powers in states of law is a thought accepted almost all over the world. The necessity of the judiciary to be independent and impartial, which is one of the most important principles accepted as indispensable especially in pluralist democracies, can also be used as a criterion in determining the level of development of states in political, socio-cultural and economic matters. While the independence of the judiciary is accepted as a principle at the constitutional level in Turkey and Yemen, it seems difficult to say that the judiciary is independent in practice. Accordingly, in this study, firstly, the definition of judicial independence will be made, then the Yemeni judicial hierarchy will be discussed and necessary suggestions will be made in the conclusion part. In this study, which will examine the projection of the independence of the judiciary in Yemen, which is extremely important in the legal plane, firstly, the issues of judicial independence, the content and protection of judicial independence are examined, and in the second part, the structure of the Yemeni state, the rule of law in Yemen and the principles of separation of powers are examined in a multidimensional way. considered and a conclusion was reached.
