Evacuation due to the needs of the new owner

Lease agreements are one of the most common types of contracts in daily life. In the Turkish Code of Obligations, product ordinary rent, residential and roofed workplace rent and product rent are regulated. Therefore, it is generally necessary to evaluate the rental agreements in three different categories. The Turkish Code of Obligations No. 6098 was adopted on 11.01.2011. With the adoption of this law, Law of Obligations no. 818 has been abolished. Before the 6098 law period, two separate laws were applied in terms of lease agreements. The first one was the Law on Obligations numbered 818 and the other was Law No. 6570 on Real Estate Leases. However, as of 11.01.2011, all provisions regarding rent instead of bilateral separation have been gathered under one roof. Lease agreements The new Turkish Code of Obligations no. 299-378 in the range of regulation area. Since the rent relations do not have a static structure, the sides of the rent relationship may change over time. The parties to the leasing relationship are the lessor and the lessor. Firstly, general information about the lease agreement will be given. In the first part, the reasons for the termination of the lease and the concept of housing and roofed work place will be discussed. Termination of the lease relationship based on the need of the new owner, which is the main subject, is the Turkish Code of Obligations. 351 and evaluations will be made within the framework of this provision. Finally, in the third section, the consequences of procedural law will be evaluated in the eviction case to be filed due to the termination of the lease agreement. In addition, both the decisions of the Court of Cassation and the different views in the doctrine are examined in this study and it is aimed to reach a conclusion in the context of all these investigations.
