Abstract (EN)

Introduction and Purpose: Disability according to Forensic Medicine; It is the evaluation of the injuries that occur or brought about in the body or the discomforts caused by the physical and chemical factors related to the occupation of the people, after the recovery period, and the sequelae failures due to the event, taking into account the profession and age of the person. In this study; Between 2018-2021, the injuries and sequelae of 219 cases, whose disability report was prepared in accordance with the "Regulation on Determination of the Rate of Loss of Working Power and Proficiency in Occupation," in the Department of Forensic Medicine, Gaziantep University, due to nervous system injury, were reported by the internationally accepted American Medical Association (American Medical Association). It is aimed to shed light on ensuring the examination and proportional standard by re-evaluating according to the Permanent Disability Assessment Guidelines and to make suggestions for new regulations that are needed internationally. Materials and Methods: Gender, age at the date of the incident, type of the incident, time between the date of the incident and the evaluation, referral center, type of injury, anatomical structure of the wound, history of operation, history of epileptic seizure and trepanasyon operation, proportional equivalents of injuries and sequelae according to the D and E charts of the "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations" whether discretion was used in determining the ratewere retrospectively scanned and evaluated for 219 randomly selected cases with nerveous injuries, upon the request of the judicial authorities, with a disability report between 2018-2021. Proportional recalculations were made using the American Medical Association Permanent Disability Assessment Manual, 5th Edition. The data were evaluated in the SPSS program. Results: Of the 219 cases evaluated within the scope of the study, %69.4 were men and %30.6 were women, the highest reason for admission was traffic accidents with 95.89%, the highest injury rate was 44.75% for isolated skull injuries, 17.35% had epileptic seizure at least once after the event. There is a statistically significant difference between the rates of loss of function obtained according to the D and E charts of "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations"and the AMA guideline. Conclusion: In the light of the findings, the "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations" chart contains deficiencies compared to the international AMA guideline, which is in use in many countries. We believe that it will be the best approach to create a guide in accordance with objective and up-to-date norms for our country, in which the disability rate can be determined according to the profession and age of the person, but which does not allow questioning and assessment while doing this; and can also be used alone in cases such as traffic accidents, work accidents, occupational diseases, terrorism, disability from duty and war.
