Abstract (EN)
Turkish Criminal Code (TCC) Law No 5237 which came into force on 1st June 2005, maintained some development on general and special provisions of criminal law. The subject of this thesis consists of fraud in the framework of TCC Law No 5237. According to this law, the crime of fraud is, defrauding someone with fraudulent behaviors and so to obtain unlawful benefit for himself/herself or another person with the result of someone?s harm. Therefore, fraud is the crime which is committed against the assets in addition to free discretion.Within this framework in the first section of the thesis general information on fraud is being presented with the history of crime and the provisions of other European countries. In the second section the terms of crime is being explained and then attempt, participating of a crime and concurrence of crimes is being stated in the third section. The last section is being finalized by penalty and types of jurisdiction.
