Abstract (EN)

The authorities used by local governments are endowed by the state. Since the state endows that authory, then the state supervise that authority. The state uses this authority through administrative supervision. The propose of this supervision is to prevent the abuse of the use of authority and facilitate the impartial use of services by the local people, and most importantly, create unity in administration. Accordingly, strong use of supervision may deviate it from its purpose. This may prevent the local administrations to make decisions upheld by their own organs. A number of new regulations aim to resolve such problems faced by local administrations in general and municipalities in particular. These regulations have reflected to municipal Code Number 5393. This code aims to render municipalities to achieve the condition mentioned in the Charter of Local Autonomy. Thus, municipalities are now free, if not totally of strong supervision they faced in the past. The fact that municipalities are relieved from that administrative supervision indicates to the new steps taken toward the conception autonomous local administration.
