Abstract (EN)

In democratic and modern societies, people protect their rights with judgment. Fair hearing is one of the basic human rights regarding the judgment and it is one of basic guarantees of a constitutional state. Fair hearing creates the basic item of constitutional state by determining the principles regarding judgment in law and criminal cases and even in administration law cases in some criteria.In a democratic society, the process of performing the law is as important as performing the law; that means the judgment process is as important as the result. 6th Article of European Convention on Human Rights regulates the fair hearing right and handles this judgment process. The fairness of the judgment depends on ending the judgment within an acceptable period. In fact this status is an indicator of the responsibility of judicial bodies for themselves rather than protecting the trust of the society to judicial bodies, providing the right to its real owner and satisfying the parties of the conflict in the shortest time.
