Abstract (EN)
In criminal law, the person who commits an act defined as a crime is referred to as the perpetrator, while the person subjected to the offense is identified as the victim. According to Article 6 of the Turkish Penal Code No. 5237, a child is defined as any person under the age of eighteen. This study examines the processes through which child victims of domestic violence access the justice system, within the scope of the Criminal Procedure Code No. 5271. In this context, it is emphasized that, with regard to child victims, the entire judicial process must be conducted with a child-friendly approach, based on the best interests of the child principle. The position and circumstances of children, who are subjected to various forms of violence by family members, are addressed in detail within the judicial process. Both national and international legal frameworks regulating the rights of victims of domestic violence are examined. The principles applied in the Turkish legal system are analyzed within the framework of the Turkish Penal Code, the Criminal Procedure Code, the Child Protection Law and Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women. At the international level, relevant practices and regulations of the United Nations and the European Union are also included. The study outlines the available complaint and reporting mechanisms for child victims of violence, as well as their ability to access the justice system. In addition, the protective and preventive measures that may be implemented both during and after the judicial process are analyzed within the context of Law No. 6284 and the Child Protection Law. Additionally, institutional mechanisms designed to protect child victims and prevent secondary victimization, such as residential care institutions, child monitoring centers and judicial interview rooms are discussed. The study also examines the responsibilities of public authorities and the roles of support mechanisms. In the final part of the thesis, recommendations are made to strengthen and facilitate child victims' access to the justice system.
