Abstract (EN)
This study, especially tries to examine the concept of a right to life and its limitations, to explain the attribution of governments on obligations and exceptions nonetheless to analyse the right to life in Turkey and the assertions about infringement of this right within the framework of The European Convention On Human Rights.In this respect, the first part of the thesis, the concept of the right to life and its limitations has been examined with the inclusion of the exceptions. In this study its aimed to reveal the positive and negative obligations that have been atributed the governments in article 2 of The European Convention on Human Rights.In the second part, the right to life concept has been examined in terms of The European Court Of Human Rights and The Turkish Constitutional Law. In this context, judgements and reasons of the court regarding infringement of the right to life has been mentioned, especially revisions about punishment of death in The Turkish Constitutional Law lately has been discussed.In conclusion, with this study importance and priority of a right to life through other human rights has been emphasized. Eventually, in this study, it has been understood that it is vital to survive a self-respecting life in a democratic society, under the legal security in order to use personal rights and freedoms.Key Words:1.
