Abstract (EN)

Defense, one of the three fundemental elements of justice, provided by lawyers. Subject of our study is, the right of attorneyship fees. Attorneyship, is an independet profession and also a public service which has the nature of monopoly. Occupations which incompatible with the profession, is forbidden for lawyers. Lawyers also subject to The Attorneyship Act and Union of Turkish Bar Assosiations Profession Rules. It is natural that they have rights to receive fees for practicing law. In this study, we will try to analyse, the right of attorney fees, with all aspects which contains the contractual fees and assignments from law. The subject will be discussed under two main headlines. In the first part, we study the concept of attorney fees and its historical development. After taht, characteristics of the contractual fees will be examined with the attorneyship contract and rules of The Attorneyship Act will compare with the draft law. In the second part, we will examine attorneyship fees determined by the court which is the another format of attorneyship fee. In this part, we will analyse the fees, according to the tariff of minimum attorney fees and types of courts and specific verdicts. Keywords : Attorneyship, Fee, Attorneyship Contract, Client.
