Abstract (EN)

In this study, the understanding of ijma of the Ja'fariyya sect, which forms the basis of the Imamiyya school, is discussed. In the first part of this study, which consists of two parts, ijma is discussed according to the scholars of Ahl as-sunnat. Scholars of Ahl as-Sunnah accepted ijma as proof and brought proofs from the Qur'an and Sunnah that it is proof. In particular, they presented the 115. verse of the Nisa Surah and the hadiths about the ismet of the ummah as a basis for ijma to be proof. At the same time, it is stated that the consensus should be based on one year; because they stated that ijma emerged with the feature of fixing a verdict rather than making a judgment. In the second part, the understanding of ijma of the Ja'fariyya sect is discussed. In addition to accepting ijma as a huccet, Ja'fari scholars ascribed the feature of discovering ijma's acquaintances. According to them, ijma is the proof of the proof. The basis of their acceptance of ijma as evidence is the hadith of Sekaleyn and the understanding of the 'Ismet of the innocent imam'. As a result, while the evidence of ijma in Ahl as-sunna was based on the understanding of the ismet of the ummah, it was based on the understanding of the ismet of the innocent imam in Ja'fariyya. In Ja'fariyye, it has been tried to find the opinion of the innocent on the subject rather than determining the verdict by consensus. Keywords: Fiqh, Ja'fari Sect, Icmâ, Usûliyyûn, Ahbariyyûn.
