Abstract (EN)
Main topic of our study is the judgement of children in Turkish Law and the special conditions relevant to this judgement. When determining those special conditions; national law system and regulations in the international law, historical development of those regulations, juvenile courts, structure of those courts, penal responsibility of children, inquirement and prosecution phases, special arrangements as regards children, procedure differing from the scope of those arrangements, and subjects whose essential rules were declared have been discussed most especially by taking support from Supreme Court's decision together with the theory and practise. The goal of the study is to determine the illegitimate conditions by ascertaining how the practise has developed in the context of theoric arrangements relevant to the subject and which practice has been adopted at the final phase, and to find solutions for this and contribute to the development of juvenile courts by putting the relevant regulations together.
