Abstract (EN)
It has become an accepted situation in almost all legal systems today that children who commit crimes at an early age and are introduced to the criminal justice system are subjected to different procedures than adults during the criminal justice process. As a result, many regulations have been made in international and national legislation to ensure that children dragged into crime are subjected to a separate trial procedure from adults. In our study, first of all, the concepts of child, child dragged into crime and underage will be defined, and then the rights of the child dragged into crime, criminal liability and the separate provisions to which it is subject will be examined. In this line the procedures and rules that will be followed differently from adults in child trials will be discussed in accordance with the principles that dominate child judgement. In our study, the situations that differ in all criminal procedure processes in terms of children who have been dragged into crime will be examined, and then the regulations on the execution of sentences about the child who has been dragged into crime will be explained. In our study, child trial will be examined in detail within the framework of both international and national regulations and universal principles related to children's rights will be addressed. In addition, national and international court decisions on children dragged into crime within the scope of the Turkish Penal Code, the Code of Criminal Procedure, the Turkish Civil Code, the Law on the Execution of Penal and Security Measures and the Child Protection Law, which are the basis of juvenile trials in national legislation, and the situations of children that present differences in from adults, will be examined.
