Abstract (EN)

In the criminal procedure, the judge or the jury tries to re-create the events that are the subject of the procedure in their minds based on evidences. Among these evidences, eye-witness testimony has always been the most used one. Eye-witness testimony is based on the human memory and because of that the testimony is susceptible to lies and mistakes. The difference of mistake from lie is it's unconsciousness. In this study the concept of proof, the basic rules of proof and reliability of eye-witness will be discussed. Keywords: Proof, Evidence, Eye-Witness Testimony, Reliability, False Memory
