Abstract (EN)
The trial process, one of the fundamental keys to uncovering the material truth in criminal procedure law, represents a significant phase that includes both an active and dynamic aspect, as well as a factual dimension where parties or participants in the trial can best express themselves. This dimension is documented according to specific procedural requirements, and other observers who are not present at the trial rely on these records to address legal matters. The trial phase concludes with a decision that reveals the material truth through the confrontation of thesis and antithesis. This process concretely reflects the principle encapsulated in the saying, "The spark of truth emerges from the clash of ideas." This study aims to contribute to a better understanding of the importance of the trial phase by practitioners and to address the challenges encountered in practice, proposing potential solutions.
