Abstract (EN)
Presidential veto, origin of which can be found in monarchies, results a number of drawbacks in the parliamentarian system, which in fact treats the relation between the cabinet set by the president and the parliament, but not the relation between the president and the parliament. The object of granting the president the power of presidential veto is, to give the parliament an opportunity to review a law enacted before or, in other words, the object is that the president warns the lawmakers on a subject which he/she regards the regulation imperfect or false. However, it may give rise to a conflict between the president and the parliament as the legislative power, a power guaranteed by the constitution exclusively belonging to the legislative organ is intervened by the head of state. In this context, a concrete determination of the scope and limits of presidential veto is of great importance for determining the position of the president in Turkish political sphere.It is indeed presidential veto which is one of the competences determining the position of the president in the system. This authority of the president is not absolute veto, but a competence which serves as an opportunity of cooperation between executive and legislative power as a result of separateness of powers.As explained above, first of all, the position of the president in parliamentarian system is analyzed in general in the light of the government system preferred in the constitution. Considering the sui generis parliamentarian system of Turkey, it is aimed to approach the subject as a whole by demonstrating the impact and importance of the powers of the president relating to the legislation over the system. Next, presidential veto, which means attracting the attention of the parliament so that the laws enacted and subject to presidential veto is reviewed by the parliament, is deeply analyzed.
