Abstract (EN)
Within the confines of our nation, the pursuit of augmented exportation is accompanied by the implementation of multifaced economic, legal, and technical strategies. Simultaneously, it is essential to safeguard domestic producers from unfair competition practices that may arise during international trade engagements. Unfair competition can take diverse forms, with one prominent manifestation being the phenomenon of "dumping." The ramifications of dumped imports encompass adverse effects such as the erosion of industrial competitiveness, an insufficiency in research and development endeavors, and diminished branding activities, among others. Whether countermeasures against dumping are bypassed through the manipulation of product origin, the identification of such manipulations and the subsequent enforcement of corrective actions become of paramount significance. In this contextual framework, the concept of dumping, regarded as one of the pillars of trade policy defense mechanisms, will be examined regarding its overarching characteristics and the pertinent legal provisions. Furthermore, this examination will encompass an assessment of the subject within the purview of the legislative measures, practical applications, and investigative protocols undertaken by both Turkey and the World Trade Organisation.
