Abstract (EN)

Syrian war which is ongoing beside to Turkey's borders continues to be area of the fight for states and their supported groups. The struggle, which started in 2011, is the scene of conflicts involving different actors as never before. The question of whether the struggle in the Syrian country is a war is unclear. Russia attend the fight in favor of the regime in Syria, with elements of the sea, land, and air. On the other hand, countries such as United States of America, Turkey, and Iran have also joined the field with their army and supported groups. The Montreux Straits Convention, signed between the two world wars, is a contract that is still valid with its content that reflects the war history and transformation of technology. In the Syrian Crisis, which started in 2011, logistics and military transport by the military and militarized civilian ships passing through the straits had an effect that changed the balance of war in Syria in favor of Russia. The weaknesses of the Montreux Straits Convention, which regulates the conditions of war and peace, came to light in this process. After the Russian aircraft had been dropped, understood that many of the articles of the contract were eroded due to ambiguity in the field of international law. In addition, because of the war became a prohibited phenomenon in this period, it is difficult to ensure the future applicability of this contract, which reclines upon the means of war. Montreux Convention which was expressed to protect Turkey's sovereign rights and safety in strait were evaluated for the need for a review of whether it was affected by the changing in the concept of war. It's intended to create a different perspective by answering this question in the discussion of whether or not the Montreux Convention is amended. In this context, the subject of the study; It was determined as the evaluation of the applicability of the Montreux Convention, which was built on the concept of classical war, by considering the Russia sample which effectively used the straits in the conflict environment in Syria. During the study period, a document based method was used by examining the written sources of the Montreux Convention, the war and the Syrian Crisis. Regarding the facts in the study, periodical newspapers were examined additionally to the treaty texts along with the author's publications, contents and minutes which were written in the historical process. In addition, the discourses on the basic facts are included in the research. The present study is aimed to test the hypothesis 'Conceptual, legal and structural transformation of War phenomenon adversely affect the applicability of the existing conditions of the contract by Turkey'.
