Abstract (EN)
Since electronic communication services have a natural monopoly structure, distinguishes itself as one of the most critical public services those must be regulated by coordinating and supervising institutions. The above mentioned services in Turkey are coordinated and supervised under the framework of assignments provided to itself by laws and decrees by Information and Communication Technologies Authority.It is inevitable for Information and Communication Technologies Authority just as in all administrative positions having qualification of organizing and supervising institution structure to have power of applying administrative sanctions as a consequence of breaches fixed out during supervision of services. Moreover when the strategic importance of these services is considered this authorization is inevitable.On the other hand, the judicial supervision of sanctions implemented against operators by the Institution are realized before administrative judicial authority when 3rd Article of Misdemeanor is considered and in fact all principles of administrative law makes it necessary.
