ABSTRACTMaster?s ThesisFlexible Working and Social Security of Workers Working FlexibleYılmaz TOPCUKDokuz Eylul UniversityInstitute Of Social SciencesDepartment of Labour Economics and Industrial RelationsIt can be said that the types of flexible working are the result of thechanges occured in the economy at the end of the 1970s. Flexiblity can bedefined as the shift of production system and the labour relations generally infavour of employer and/or the according to the rule of the contract for theintention to prevent the company to be affected from the changes occured in thesupply and demand or to decrease the degree of being affected and to adapt tothe competition requariments. Flexibility can also be defined as the adaptationof the company to the abrupt changes without obeying the rules. On the otherhand, it can be seen that flexibility is creating an uncertain process when theunemployment reachs to its highs for the workers who are not protected by therules and the social security foundations.In our country, flexible working took its place in practice before theadequate legislative studies been done. In the doctrine, between the appliers andin the juridical area serious arguements have been done. The flexible working,which began to be applied without any legal support and so, was applied by thedirections of decisions of supreme court, finally has taken its place in theregulations as being regulated in the Turkish Labour Law no. 4857 which is inforce since 2003. In the doctrine, the situation of the flexible working workershas been -generally- questioned in the frame of labour law. But essentially thesocial security is also another area which interests the working life as much aslabour law. The labour law and the social security law, which are connected tothe working life with strong bonds are like a parts of a whole.In the study, the social security rights of the flexible working workersand the conditions for these workers to take the advantage of the social securitybenefits have been examined, and the effects of flexible working to theproducing, employment and the foundations of social security have beenstudied. In this context, in the first part of the study, the definition of flexibleworking, the factors affecting the flexible working, types of flexible workingand its affects on the working life have been investigated. In the second part,the social security rights of flexible workers has been examined and someexamples from the western countries where the flexible working is commonhave been given. In this part, also the labour and the social security laws havebeen compared and the problems which the flexible working workers areencountring in social security in our country have been defined. Finallay in theconculusion and appreciation, some suggestions for the solution have been madefor the defined problems.
