Preservation of matrimonial unity by means of judge's intervention

A humanbeing is born within a family and lives in a family. He/she becomes a part of social life with manners and values earned within the family. Therefore, the family has always been of legal significance. The society at large has also certain interest in the preservation of matrimonial unity, as well as the spouses themselves. Therefore, the legislation have numerous provisions on the preservation of matrimonial unity, starting with the foremost source of Family law; the Turkish Civil Code. The purpose of these provisions ıs to maintain the matrimonial unity in case of potential conflict and to avoid a divorce or seperation. The subject of this study is the evaluation of the provisions on the preservation of the matrimonial unity. The study consists of three main parts: starting with in detail analysis of the concepts of family, matrimonial unity and state-family interaction. Secondly, the provisions under 195th and following articles titled ?Preservation of Unity? are evaluated. Finally, the provisions with regard to preservation under Law on Protection of Family no. 4320, which was enacted specially for the prevention of domestic violence is further assessed.
