Abstract (EN)
Marriage is a union established by two opposite sex people at their own will. This union is called the marital union and continues with the fulfillment of the obligations that the spouses are responsible to each other. However, in some cases, this union can be terminated by the spouses. The subject of our thesis is "The Termination of Marital Union According to Article 162 of Turkish Civil Code". Our thesis consists of three main sections. In the first part, in order to better understanding of the causes and consequences of divorce based on article 162 of Turkish Civil Code; marital union and the termination of marital union will be defined. Subsequently, divorce and grounds for divorce regulated in Turkish Civil Code will be discussed. In the second part of our thesis, attempt against life, very bad and defamatory behavior will be defined respectively, which are the reasons for divorce within the scope of article 162 of Turkish Civil Code, afterwards the divorce cases which may open based on these reasons, will be discussed in the light of the Supreme Court's decisions. In the last section, which is the third one, the results of divorce cases filed on the basis of article 162 of Turkish Civil Code will be discussed. We will focus on what these results are and how they take place.
