Crime of transgression against immaterial, financial or connected rights in Law on Intellectual and Artistic Works

As a corollary of developments in the fields of science of technology; intellectual property law have arisen out of the classical notion of property and the need to protect intellectual products stemming from humane intellectual work and efforts. Through the ever-growing and ever-changing new world order, and the information age that emerged concomitantly with the latter, intellectual products qualitatively different from the classical notion of property and dissimilar to classical understanding thereof, have gradually been prone to various infringements. Specifying legitimate and illegitimate acts in human behavior against such frequent violations have proved particularly difficult given the progressive, changing and developing character of intellectual products. Efforts for defining fundaments on which an effective protection under prevalent conditions would be based are still ongoing in both civil and criminal spheres, and on domestic and international planes. Since, at the domestic level, being one of such legal remedies, and envisaged in the Law no. 5846 on Intellectual and Artistic Works, dated 1951, the "crime of transgression against immaterial, financial or connected rights" pertinent to the penal protection of rights on such works have been the most frequent violation, the mentioned crime deserves scholarly attention. It is in this context that this research focuses on the crime of transgression against immaterial, financial or connected rights.
