Abstract (EN)
Liability arising from tort is one of the two main sources of compensation liability in Turkish law and is a type of liability based on fault as defined in Article 49 of the Turkish Code of Obligations No. 6098. In this study, various issues such as how the proceedings are conducted in cases of non-pecuniary damages arising from tort, the problems experienced in practice, how the discretion is used by the judge and the criteria by which this discretion is controlled are emphasised. In this context, this thesis aims to provide a comprehensive evaluation of the problems encountered in civil procedural law in cases of non-pecuniary damages arising from tortious acts.
