Abstract (EN)

The main objective of this study is to examine advertisements causing unfair competition. In this regard, the first part elaborates the term, unfair competition and features concerning regulations in Turkish law. The second part aims to examine the definition of advertisement, its key elements and forms. Besides, this part explains some forms of advertisement which may cause unfair competition. The last part examines legal remedies against advertisements causing unfair competition.The study asserts that the term, advertisement shall be interpreted in broad terms and relies on the instable nature of the advertisement and advertisement channels to support this theory. In this regard, it argues that advertisement may cause unfair competition with its content and form. Furthermore, it indicates that administrative supervision on advertisements and the regulation concerning unfair competition have a convergent function on supervision of advertisements in Turkey.Keywords:1) Advertisement2) Unfair competition3) Board of Advertisement4) Misleading advertisement5) Comparative advertisement
