Abstract (EN)
The concept of competition is one of the indispensable elements of commercial life and aims to establish the relations between the parties on an honest basis and to ensure the interests of the parties first and then the society. The concept of unfair competition has emerged as a result of the establishment of a competitive environment; in order to prevent the abuse of this competitive relationship, to protect the parties and interests of the competition in areas where honest and undistorted competition cannot be realized, it has been limited within the framework of legal regulations and sanctions have been stipulated. In this master's thesis, firstly, the right to competition, which is a constitutional right under Turkish Law, is evaluated within the framework of the laws, and the actions constituting unfair competition under the Turkish Commercial Code No. 6102, the obligations to be imposed on the parties as a result of these actions, and the remedies and lawsuits to be filed by those whose interests are damaged or who are in danger of being damaged are evaluated within the framework of the law.
