Abstract (EN)

Limitation of power means preventing the abuse of all kinds of power and authority, regardless of the political administration system. Political power, which has the monopoly on the use of force, has a very important role in ensuring social order and peace. But the danger of abuse of this power is always possible. The way to prevent the abuse of political power and its destructive consequences is only possible by limiting, balancing and controlling this power. Humanity, realizing that political power must be limited in order to ensure freedom and security, has tried to find the means and rules to limit power. Today, the principle of the rule of law is accepted as one of the most effective tools to limit political power. The subject of this article is the relationship between the principle of the rule of law and the limitation of political power. The main purpose of the study is to analyze whether the principle of the rule of law, which is one of the most effective tools to limit political power, has changed after the 2017 Constitutional amendment, and whether the changes made are in the direction of strengthening or weakening the principle of the rule of law and as a result to make a general evaluation about the constitutional regulations regarding the rule of law in the context of limititation of political power. The main finding of the study is that the 2017 Constitutional amendments weakened the principle of the rule of law, and therefore the constitutional system lacks the level to prevent abuse of power.
