Abstract (EN)

State governed by rule of law (Rechtsstaat, Êtat de Droit) is the state that laws can be known and the state is responsible for obedience to their own laws and refrains from arbitraries. The complying with judicial decision by the administration shall be a requirement of the rule of law. Article 138 of the Turkish Constitution lays down that the legislature, the executive and the administration shall comply with court decisions. Article 28 of the Administrative Jurisdiction Procedure Law No. 2577 lays down that the administration to execute judicial decisions without delay and this period shall not exceed thirty days. In our study, the liability of the administration to execute administrative judicial decisions and related issues are discussed within the framework of the state governed by rule of law.
