Abstract (EN)
In this study, we aimed to process termination issues in terms of work, workplace and operation requirements in the case of employment law. Our study consists of four main sections. In the first section, the basic concepts related to the subject are mentioned and in the second section, the terms of operation, workplace and work are covered under the current termination heading. In the third part, the other cases that may constitute the need for operation are mentioned and in the fourth section, the subject of supervision of the employer's decision is discussed. In the first part of the study, the meaning of the concepts of work, workplace and business is mentioned. In the second part, it was mentioned that the situation of business, workplace and work would give rise to a possible termination state and the scope of the employer's freedom of business decision was tried to be determined. The employer cannot make an arbitrary business decision and its limits are indicated by the Court of Appeals and doctrine. In the third chapter, although the cases which may be required for operation in the law are not listed, other cases which are deemed to be operational are stated in the light of the decisions of the Court of Cassation. In the fourth section, the control of the right of termination of the employer for valid reason is examined.
