Realisation by electronic auction in debt enforcement law

The advancement of technology, results in area of law as well as in every area of our lives. At the present stage, parties of a jurisdiction have become to be able to defend themselves in front of screens as if they were in a courtroom; representatives of the parties have become to be able to submit affidavits, checkover the documents and attend to hearings in a lawsuit through the system. Recently, some new and actual regulations are made in debt enforcement law, too, owing to these developments in area of law. According to these regulations, the auctions in context of debt enforcement law shall be made in the internet using an auction platform, without the need of presence on auction halls. Buyers, who want to participate in an auction will be able to do this through the electronic platform on the internet and have a chance to bid for the subject of auction with these new regulations made with the Law No. 7343 dated 30.11.2021 and published on Official Gazette No. 31675. Realisation by electronic auction, which is the next step of preview regulations on bidding online in context of debt enforcement law, has brought multiple changes on the method of realisation, while aiming to reduce many issues happening before, during and after auctions. In this study, the subject of realisation by electronic auction under Article 111/b in the Act of Debt Enforcement and Bankruptcy No. 2004, which came into effect with the changes and additions in Law No. 7343 will be examined.
