The right to health in the context of human rights

There is a very close relationship between the right to life and the right to health. The right to health, which has developed as a necessity of the right to life, appears in two aspects. The first of these is the person's right to access appropriate treatment in case of illness. The administration ensures the necessity of this right through health organization and hospitals filled with modern devices and competent physicians. Another aspect of the right to health is the right to stay healthy. It can also be expressed as protecting the person from physical and psychological external factors that harm his health. The right to stay healthy, which is the second aspect of the right to health, brings many obligations to the administration. Of course, the right to health should not be violated by the administration itself. A healthy and balanced environment, clean environment, food, water, solid and livable cities and housing, etc. In addition to many other requirements, preventing physical and psychological violence through a well-functioning law enforcement and justice system is also required to realize the right. All these responsibilities are imposed on the administration in the sense of positive obligation. In accordance with the principle of equality, the administration is obliged to take the necessary measures to ensure that everyone receives equal health care. Everyone should have access to scientific data regarding health, efforts should be made to increase medical knowledge and experience, and data related to medical science should not be subject to censorship unless there is an ethical or moral problem. The administration also fulfills the requirements of the right to health, including refugees, disabled people, prisoners, etc. The situation and conditions of people with special circumstances should not be ignored. It is seen that in Turkey, as a requirement of the Social State principle, very comprehensive measures have been taken and continue to be taken in order to fulfill the requirements of health services and to protect general health.
