Abstract (EN)
With the day by day advancement and development of technology, technological communication tools have started to be used in our homes and workplaces. The fact that computers, internet, camera and mobile devices facilitated human lives has also affected the working life and enabled employers to integrate technological tools into the business life. In this way, the employer had the opportunity to monitor the workplaces with the camera in matters such as ensuring workplace safety, increasing productivity and measuring production capacity. According to Turkish Code of Obligations article 417/2 and Code No. 6331 article 4 every employee, must protect personal integrity and health of the employers and take appropriate measures. The employer's obligation to protect the worker gives the employer the opportunity to monitor their workers for protection in the workplace environment. Although the use of electronic communication tools in the business life has provided many facilities for the worker and the employer, it has caused some problems in terms of employee's personal rights, privacy and protection of personal data. In the first part, the concept of worker, employer and workplace is emphasized, and in the second part, the concept of personality rights and its scope is emphasized and the effect of personality rights on business life is examined. The audits of the workers by the employer through electronic communication tools are taken under national and international protection both in terms of the personal rights of the workers and their working lives. For this reason, in the third part, the regulations regarding the protection of the personal rights of the employee in the workplace are included. In the fourth chapter, the methods used in carrying out these actions are listed by mentioning the reasons for monitoring the worker at the workplace, and the ECHR decisions on the subject are emphasized. In the fifth and last chapter, the results of the employee monitoring and surveillance in the workplace in terms of workers and employers are discussed in detail.
