Abstract (EN)

The subject of thesis is about basically not discriminating employees because of their sexes, religions, communions, races, political views, philosophic thoughts and etc. In other words, the principal of ?responsibilities of equal treatment of employers? that is the view in labor law of ?principal of equality? that must be observed in every field of law will be examined in a detailed way from this aspect.There is a direct legislation and a sanction about not making discrimination based on sex, religion and communion, political view and etc reasons in Turkish Labor Law no. 4857. So, it can be said that the principal of equal treatment with Labor Law No. 4857 by means of Turkish law has been one of the basic principles of Turkish Labor Law beyond one of the responsibilities of the employer. But this subject?s becoming a current issue is highly new. Consequently regulations regarding the principle of non- discrimination in international law are also taken into account in this study alongside domestic resources of law. In this study, basic terms concerning the subject are examined, and subsequently which treatments may constitute discrimination in workplace are discussed. Moreever the subjects of the sanction for violation of ?responsibility of equal treatment? and burden of proof will be analyzed.
