Analysis of the transfer process and functionality of the ombudsman institution

In this study, the extent of which the legislation and institutional transfer process affects the functionality of the ombudsman institution that have become globally prevalent after the Second World War in the framework of its creation in Turkey is analyzed. This study is limited to the Ombudsman Institution that was created by the law no. 6328 in 2012 in Turkey in the national level. In the study process, qualitative research method is chosen and the document analysis technique is used to acquire data. The Analysis Through Policy Transfer Analysis Questions approach is adopted in the analysis of ombudsman policy transfer process that was carried out on the basis of policy transfer theory. In the analysis about the functionality of the ombudsman institution, the findings from the scale of indicators that were developed by the assumptions that were put forth by the principles that specify the standards of international ombudsman and policy transfer theory are evaluated. As a conclusion, the following hypotheses of the study are verified: the transfer process and the functionality of the ombudsman institution don't completely meet with the assumptions that were put forward by the policy transfer literature; the institution doesn't completely meet with the indicators of independency and impartiality which are in accordance with the international standards; the level of functionality of the institution is below the international standards; it is not possible to speak of an ombudsman mechanism that has a high level of functionality in Turkey.
