Abstract (EN)
In this study, the factors that deforms the balance between freedom and authority while public safe is providing and the principles which can fix this balance was examined. Particularly, how laws states produced and practices they accomplished against national and international terror which become an important threat to safety all over the world affect individual rights and freedoms was studied. The attitude of judiciary powers against deformation of the balance between freedom and authority was put forth. The scope of the topic which debated in European Court of Human Rights was analyzed and it was tried to determine that under which conditions the role of the states in protecting the balance between freedom and authority differs while providing the public safety.
