Abstract (EN)
The situations that prevent the carriage or delivery from being carried out in accordance with the contract are named as "carriage and delivery obstacles" in the transport law terminology. Due to the importance of the institution, detailed regulations regarding carriage and delivery obstacles in goods transport by road are included in the 869th provisions of the TCC and the 14th and 16th articles of the CMR. In the presence of these obstacles to performance in the field of transportation law, some obligations are imposed on the carrier. In return for these obligations, certain claims have been granted within the framework of the risk area principle.
