Abstract (EN)

Our thesis titled "The Effect of Default on Third Parties in a Construction Contract in Return for Flats" deals with the legal situations faced by third parties who are entitled to rights under a construction contract in return for flats in case of default in the contract. The construction contract in return for flat is a unique contract. The construction in return for flat contract is a contract that has an important place in the Turkish legal system and that we frequently encounter, but does not have a complete definition in the legislation. For this reason, in order to make this contract understandable, the basic aspects of the contract are included in the first part of the study. One of the frequently encountered situations in construction contracts in return for flats, which directly affects the parties and third parties, is the default of the contractor. The default of the contractor directly affects the parties to the contract and third parties. For this reason, in this study, the default of the contractor is discussed before proceeding to the rights and legal status of third parties. Finally, the main subject of the study, the rights of third parties in the construction contract in return for flats and the problems and legal status of third parties in case of default of the contractor are included. In the study, the different opinions of the authors in the doctrine and the opinions of the Court of Cassation are included, and it is aimed to explain the subject of the study in broad terms.
