Abstract (EN)

As the increasing security needs of the states intensified in line with the advances in technology, the secret and dynamic structures of the intelligence organizations brought along the risk of unfair interference with the privacy of people's private life. Interception of communications, surveillance and monitoring of internet networks within the scope of the principle of confidentiality can cause intelligence agencies to interfere with private life. Accordingly, the unlawful actions of the intelligence services, a powerful organ of the states, that cause a violation of privacy and lead to arbitrary practices, reduce people's trust in the state. Defining the legal boundaries of intelligence services clearly is important in terms of ensuring the democratic oversight of these agencies. In this direction, making intelligence accountable and auditable ensures the protection of fundamental rights and freedoms of individuals and the elimination of grievances.
