Appeal application, appeal review and the judgments of appeal court in Civil Procedure Law

The study, under the title of Appeal Application, Appeal Review and the Judgments of Appeal Court in Civil Procedure Law comprises an introduction and three chapters. In this study, the fundamental characteristics and main phases of the new appeal system, which was adopted with the reform act in 2004, have been examined.In the first chapter, historical development of the appeal, the fundamental rules of the appeal, the main characteristics, the purpose and the subject of appeal have been examined. Also the place of the appeal among the other review procedures and the judgments that are subject to the appeal have been analyzed. In this chapter particularly the comprehensive and simple appeal systems have been handled.In the second chapter of the thesis, under the title of Appeal Application, the persons who have the right to appeal, abandon of the appeal, withdrawal of the appeal application, period set for appeal filing, jurisdiction of the appeal court, the form of appeal application, filing an appeal with a responsive brief, grounds of appeal and demands of appeal have been examined.In the third chapter, under the title of Appeal Review and the Judgments of Appeal Court, phases of pre-review, review, oral hearing and judgment have been examined. In this chapter, under the title of Pre-Review, the subject and results of pre-review have been handled. Under the title of Review, the conduction of review, the scope of review, the transactions of the parties which are not allowed in appeal, the facts and evidences which are admitted in the appeal and finally trial have been analyzed. Under the title of The Judgments of Appeal Court, the judgments that can be given at the end of the pre-review and review, preliminary injunction in appeal and formal characteristics of the appeal court?s judgments have been examined.
