Abstract (EN)
The purpose of this dissertation, entitled ?Ad Hoc Arbitration Proceedings Within the Framework of International Arbitration Law and UNCITRAL Arbitration Rules?, is to evaluate the proceedings of ad hoc arbitration which is a type of international commercial arbitration, within the framework of International Arbitration Law No: 4686 and UNCITRAL Arbitration Rules of which is revised in 2010. The first chapter of the dissertation analyses the concept of international arbitration and describes the basic elements of it. According to these analysis, the concept of arbitration involves; arbitration agreement, arbitrator agreement, basic contract, arbitrationa proceedings and the law applicable to arbitration.The second chapter of the dissertation mentions the analysis of the ad hoc arbitration proceedings under the International Arbitration Law within the framework of Uncitral Arbitration Rules. Ad hoc arbitration allows the implementation of an arbitration process within a framework of specific arbitration rules agreed by the parties concerned without the need for any particular institution. The rules that the arbitral tribunal must follow and to which the arbitration process must conform are drawn up with the agreement of all parties concerned, solely for the purpose of a specific agreement. For parties that decide on ad hoc arbitration, UNCITRAL Arbitration Rules offer soft and guiding rules that they can shape with their own free will to suit their particular needs. The International Arbitration Law, as having the similar provisions with the UNCITRAL Arbitration Rules, is an indication of the significant progress in Turkish Law in the field of international arbitration.
