Abstract (EN)

The aim of the thesis is to examine the foreign arbitration decisions in international arbitration in the case of finalization, recognation and enforcement. The subject of the thesis was examined within the scope of the provisions of the Law of International Arbitration and international charters and evaluated according to the decisions of the Higher Court of Appeal on the matter. Additionally, there are samples from the laws of the other countries and their implementations are included in the thesis. During the preparation of the thesis, the different views in the doctrine and various implementations were included by using the domestic and foreign resources on the matter. The view of the Higher Court of Appeal stated in depth, too. As a result, the legal remedies which can be used during the phase of finalization of the foreign arbitration decision and which can be applied during the phase of recognation and enforcementl were gathered in the same study, thus, it was figured out that there must be changes in the current legislation in Turkey if it becomes a more attractive arbitration centre.
