Abstract (EN)
This research aims to critically edit the manuscript "Al-Muntaqā fi Sharḥ al-Multaqā" by Mustafa al-Askadari, one of the significant commentaries on the text "Al-Multaqā", which is considered an important source in Hanafi jurisprudence. The topic was chosen due to its importance in understanding Hanafi jurisprudence and advancing legal studies, as well as the challenges involved in editing this manuscript, which contains numerous issues requiring precise verification. One of the difficulties in editing this manuscript lies in the discrepancies among the available copies, necessitating careful scrutiny to establish the correct texts. Furthermore, the author's methodology requires an in-depth study to understand the approach used in explaining and clarifying the legal concepts presented. This study relied on analyzing the commentator's methodology and style in explaining legal texts, alongside a comprehensive examination of the life of the author of Al-Multaqā, Ibrahim al-Halabi, and the life of the commentator, Mustafa al-Askadari. The research also documented the attribution of the book. It was divided into several chapters addressing various aspects of the topic, starting with an introduction to the book, an analysis of its contents, and concluding with the text intended for editing. Al-Askadari demonstrated a distinctive approach in his commentary, balancing detailed explanations with legal preferences, while providing practical examples to clarify legal issues. He was meticulous in documenting scholars' opinions. A noteworthy feature of this commentary is the author's explicit mention of Hanafi opinions and preferences using phrases such as "I say," "We say," "Our view," or "According to us," supported by evidence from the Qur'an or Hadith. In certain issues, he also offered his own preferences.
