The Palestine-Israel crisis as a present crisis: A historical, political and legal assessment

The problem, which started between the Palestinian Muslim people and the Jewish community in the late 19th century and turned into a Palestine-Israel crisis with the establishment of the State of Israel, still continues in the first quarter of the 21st century, as it has not been resolved. The fact that many studies have been carried out on the subject over the years does not mean that the Palestine-Israel crisis is a standard issue, on the contrary, the missing parts should be examined with more academic studies until the problem disappears. The increasing continuation of the crisis between the parties draws attention to the questioning of international law and its deficiencies in practice. This situation between Palestine and Israel has ceased to be a crisis that concerns only two actors, but has turned into a problem involving the neighboring Arab states in the Middle East geography as well as the great powers in the international arena. Especially in the academic studies prepared in recent years, the reason why the Palestinian-Israeli crisis cannot be resolved is stated as the deficiencies in the Palestinian administration. It is forgotten that a crisis that has been going on for more than 70 years cannot be resolved, and that it may cause new problems with each passing year, and accordingly, the Palestinian people, whose borders are not clear and who live as refugees, are struggling with many internal turmoil. The attitudes towards international law that the State of Israel took before or after its establishment is customarily merely repeated. Since its establishment, the United Nations has made significant efforts to end the crisis between Palestine and Israel peacefully. However, the fact that the final decisions of the Security Council depend on the 5 permanent members while determining the functioning of the UN Organization, and the functioning of the institution and the fact that even the decisions that seem to be correct cannot be taken through veto, have also had negative effects on the Palestine-Israel crisis. Despite the UN institution's desire to bring a solution to the issue, its veto power has been the key point in its own impediment in the implementation of the Security Council resolutions. The aim of this thesis is to examine whether the international law, believed by the international community, has followed a fair enough path between the parties towards the Palestine-Israel crisis, and to address the findings obtained during the process and the deficiencies of the actors during the resolution process. In order to conduct a research on international law in the Palestine-Israel crisis, first of all, it is necessary to have a good grasp of the historical process of the parties. In the first part of this thesis, the definition of the "Concept of Crisis" in which the parties are involved is made and how a problem turns into a chronic crisis is explained. In the second part, the history of Palestine and Israel, which is an example of a chronic crisis, is looked at. In the third part, the developments in the recent history from the establishment of the State of Israel to the present are examined. In the last part, the initiatives taken by the United Nations agency, which is an instrument of international law and implementation, the decisions taken and whether the applicability of these decisions depends only on the great powers are questioned. With the results obtained, it is concluded that the international community turns into a great power when united and the law of the strong is not always valid in this order.
