Abstract (EN)

Marriage is a religious arrangement that meets the physical, psychological and sociological needs of the spouses. The purpose of marriage is to provide these needs in a halal way and at the same time to fulfill the requirements of servitude. These are the continuity of the generation, the increase of the ummah, the protection of women, ensuring their alimony and protecting people from adultery. In this study, it is aimed to make an evaluation within the framework of the regulations and moral principles in Islamic law by addressing the issue of privacy during the engagement process in Islam. The thesis consists of two main parts. In the first part, the conceptual framework is drawn, and in the second part, the privacy rules during the engagement period are examined in detail. In the first part, the concepts of khutba and engagement are defined, engagement capacity, declaration of will, legal consequences of engagement and the conditions sought by the parties are discussed. Additionally, the similarities and differences between engagement and sermon are discussed; The implications of the promises made when asking for a girl for marriage were examined. In the second part, privacy rules during the engagement period are discussed in more depth. The limits of the engaged couples (hatib and mahtûbe) looking at each other before the wedding, the situations and conditions in which this look is permissible were evaluated. In addition, in this study, the sensitivity of Islam regarding privacy during the engagement period is emphasized, modern problems frequently encountered during the engagement process are discussed in the light of classical fiqh texts, and as a result of the study, it is clearly revealed how an engagement process in accordance with Islamic law can protect the spiritual and social peace of individuals. 2024 – ix + 59 Pages Keywords: Hıtbe, Engagement, Hatib, Mahtûbe
