Abstract (EN)

Actions aimed to the ?Right of privacy? mentioned in 20th article of Constitution Act,1982 and in 8th article of European convention on human rights, are regarded as crime and became judicial subject in Turkish Penal Code numbered 5237, dated 01.06.2005. Violation of privacy crime was not met clearly in abolished Turkish Penal Code numbered 765. Violation of privacy regulated in 134th article entitled ?crimes against right of privacy? of Turkish Penal Code numbered 5237. The right to privacy -protecting the privacy of individual and family life, home and correspondence of individual against arbitrary interference- is a kind of right which assures keeping individual choices and chosen ways of life away from interfering. About the right to privacy and its protection, this study aims: to reveal the scope of this right, to determine in what way it is being protected in national and international law, to explore in which circumstances the violations appear.
